Eligibility for ESIC Registration

Any non-seasonal factory or establishment employing more than the prescribed number of employees (typically 10, or 20 in some states) is required to register under the ESIC scheme if the employees fall within the applicable wage limit. Registration must be completed within the specified time from the date the scheme becomes applicable.

Under this scheme, both employer and employee contribute a fixed percentage of wages. The employer contributes a higher share, while the employee contributes a smaller portion. However, employees earning below a certain daily wage threshold may be exempt from making their contribution.

Entities Covered Under ESIC

As per the ESI Act, various establishments are required to register under ESIC based on employee strength and nature of business.

Under State Government (Section 1(5))
The following entities are covered:

  • Shops
  • Restaurants and hotels engaged in sales
  • Cinemas, including preview theatres
  • Road motor transport establishments
  • Newspaper establishments (not covered under the Factories Act)
  • Private medical institutions
  • Private educational institutions
  • Casual employees of municipal corporations or local bodies

If these establishments employ more than the prescribed limit (generally 10 employees), ESIC registration becomes mandatory.

Under Central Government
The following entities are also covered:

  • Shops
  • Hotels and restaurants
  • Road transport establishments
  • Cinemas, including preview theatres
  • Newspaper establishments
  • Businesses engaged in insurance
  • Non-banking financial activities
  • Port and airport authorities
  • Warehousing services

For these entities, registration is generally mandatory if the number of employees exceeds the specified threshold (commonly 20 employees).

What is the Registration Process of ESIC?

ESIC registration is completed online through the official portal. Below is the first step in the process:

Step 1: Employer Registration on ESIC Portal
The employer needs to register on the ESIC portal by selecting the “Employer Login” option. This is the initial step to begin the ESIC registration process.

Step 2: Sign-Up and Submission
On the next page, click on the “Sign Up” option. Fill in the required details and submit the form.

Step 3: Confirmation Email
After submitting the form, a confirmation email and message are sent to the registered email ID and mobile number. These contain the login credentials (username and password) required for further registration.

Step 4: Employer Registration (Form-1)
Log in to the portal using the credentials received. Click on “New Employer Registration” and select the type of unit from the dropdown menu.
Proceed to fill in “Employer Registration Form-1” by entering details such as employer information, establishment details, and employee details. Once completed, submit the form.

Step 5: Initial Contribution Payment
After submitting the form, a prompt will appear to pay the initial contribution. Click on “Pay Initial Contribution,” select the online payment mode, and proceed. A challan number will be generated for reference. Complete the payment through the available payment options.

Step 6: Registration Letter (C-11)
Upon successful payment, a system-generated registration letter (C-11) is issued. This document contains the unique 17-digit registration number and serves as proof of ESIC registration.

Documents Required for ESIC Registration

The ESIC registration process is fully online, so no physical submission is required. However, certain documents and details must be provided during the online application:

  • Registration certificate under the Factories Act or Shops and Establishment Act
  • Certificate of incorporation, such as:
    • Company registration certificate (for companies)
    • Partnership deed (for partnership firms)
  • GST registration certificate of the establishment
  • Memorandum of Association (MOA) and Articles of Association (AOA) for companies
  • Address proof of the establishment, such as:
    • Recent utility bills (electricity, gas, or telephone)
    • Rental agreement
    • Property tax receipt
  • Employee-related details, including:
    • List of employees
    • PAN details of the establishment and employees
    • Salary and compensation details
    • Attendance records
  • Cancelled cheque of the company’s bank account
  • List of directors (in case of a company)
  • List of shareholders

These documents help verify the establishment’s identity, operations, and employee details for ESIC registration.

Compliances After ESIC Registration

After obtaining ESIC registration, the employer must ensure ongoing compliance with the following requirements:

  • Maintain an attendance register for employees
  • Maintain a wages register
  • Keep an inspection book
  • Submit monthly contributions and challans by the due date
  • Maintain a register of accidents occurring at the workplace

Returns to be Filed After ESIC Registration

ESIC-registered entities are required to file half-yearly returns. The following records are generally needed:

  • Employee attendance register
  • Form 6 (Register)
  • Wages register
  • Accident register
  • Monthly challans and contribution details
